TERMS AND CONDITIONS

USED CAR FINDING SERVICE

  1. All used vehicle requirements will be fully defined and agreed between the client and MOTORMISSION Ltd. The client usually initiates this process by submitting a Proposal form, via the MOTORMISSION Ltd website, or it can be done by phone.
  2. MOTORMISSION Ltd will send a Supply Agreement by email/post for the client's approval. The Supply Agreement will contain the following information -
    1. Full details as set out in the original Proposal form, including any amendments that were subsequently agreed by email/telephone (e.g. any additional extras).
    2. An approximate price range of the vehicle, split between a 10% deposit and an estimate cost of the residual balance (eg. where we quote to supply a car at say a cost of between £5,000 and £5,500 we would calculate a 10% deposit based on the lowest approximated cost (£5,000) and therefore, in this example, the deposit required is £500 and the final payment due on delivery would be between £4,500 and £5,000.
    3. Payment terms, including MOTORMISSION Ltd Terms of Business.
  3. When the client is completely satisfied with the Supply Agreement, they should sign it and returned it to MOTORMISSION Ltd together with the required 10% deposit.
  4. Upon receiving a Supply Agreement and the deposit, MOTORMISSION Ltd will issue an electronic receipt to the client's email address or by post to the customer's home address.
  5. MOTORMISSION Ltd will then proceed to locate and inspect prospective vehicles on behalf of the client.
  6. In the unlikely event that after 21 days of MOTORMISSION Ltd receiving the signed Agreement, we are unable to locate a suitable vehicle, MOTORMISSION Ltd guarantee (at the client's request) to return their deposit by cheque.
  7. In the event of the client wishing to change their decision at any stage to proceed with the order, as per the Supply Agreement, after MOTORMISSION Ltd have purchased the vehicle then MOTORMISSION Ltd would not be able to refund the deposit.
  8. Should the client decide not to proceed within the first 10 days of MOTORMISSION Ltd receiving the signed Supply Agreement, and assuming MOTORMISSION Ltd had not purchased a car for the client, MOTORMISSION Ltd would return the original deposit, less an administration fee of £120. This covers the cost of work that will have been undertaken on the clients behalf. Should the client decide not to proceed between the 10th day and up to the 21st day from MOTORMISSION Ltd receiving the signed Supply Agreement, and providing no vehicle has been purchased for the client, we would return the original deposit, less an administration fee of £250.
  9. MOTORMISSION Ltd guarantee to provide vehicles that are in good condition in relation to their age and mileage, except for normal wear and tear.
  10. MOTORMISSION Ltd will provide customers with an adequate test drive and sufficient time to inspect the vehicle prior to acceptance. The supplied Warranty will be explained on delivery to the Client.
  11. If, on delivery, the client finds that the vehicle is not as specified in the Supply Agreement or in a suitable condition the client should notify MOTORMISSION Ltd as soon as is reasonably practicable. If MOTORMISSION Ltd determines that the vehicle is not as specified in the Supply Agreement or in a suitable condition (taking into account the age and mileage), MOTORMISSION Ltd guarantees to either:
    1. Rectify the problem, or
    2. Replace the car, or
    3. Refund the original deposit, or full payment if this has been paid to MOTORMISSION Ltd.
  12. MOTORMISSION Ltd will deliver vehicles to clients, at no extra charge, to any address up to 40 miles from Fleet, Hampshire. Delivery beyond 40 miles can be provided and costs will be agreed with MOTORMISSION Ltd in the Supply Agreement. Clients are also most welcome to collect their car from MOTORMISSION Ltd registered premises.
  13. CAR TAX IS GENERALLY NOT INCLUDED WITHIN THE PRICE OF THE VEHICLE, although MOTORMISSION Ltd can tax a vehicle before delivery on the clients behalf and the cost of the tax will be added to the final invoice. The relevant documentation relating to the vehicle, including the Warranty Agreement, will be handed over to the customer at time of delivery.
  14. Delivery times are flexible and by prior arrangement.
  15. MOTORMISSION Ltd will issue a VAT registered receipt to the customer upon receipt of the full payment. (For acceptable payment methods, please refer to our payment terms below).     USED CAR FINDING – PART EXCHANGE

  16. Clients wishing to use MOTORMISSION Ltd part exchange facility should provide as much detail on their car as possible, ideally on the on-line proposal form. MOTORMISSION Ltd may subsequently contact the customer to clarify their vehicle details after which, we would provide an indicative 'trade-in' value.
  17. Within the Supply Agreement, MOTORMISSION Ltd will provide a value range and, subject to paragraph 18 below, guarantee to pay at least the lowest estimated value, subject to the above paragraph.
  18. All estimates quoted by MOTORMISSION Ltd are conditional and may be changed if the vehicle does not prove to be as the customer described on physical examination. In the event that a vehicle for part exchange is found to have been subsequently damaged or is not in the condition described by the customer, then MOTORMISSION Ltd reserves the right to amend the estimate and/or terminate the Part Exchange Agreement. In the case where a Part Exchange Agreement is terminated, the client must then either choose to supplement the outstanding balance or, cancel the order and forfeit their deposit.
  19. Subject to paragraph 18 above all part-exchange values quoted by MOTORMISSION Ltd are valid for a period of 21 days. USED CAR FINDING – PAYMENT TERMS
  20. The 10% deposit is payable by cheque made out to ‘MOTORMISSION Ltd’.
  21. Any outstanding balance is due to MOTORMISSION Ltd on satisfactory delivery and receipt of the vehicle. Vehicles will not be released to clients until all payment has been cleared. Re-locating clients are required to pay the outstanding balance of a sourced car within 10 working days of notification of purchase.
  22. Acceptable payment methods are Cash; Bankers Draft; Building Society Cheque or by Bank Transfer (BACS or CHAPS). Vehicles will not be released to the client until funds are cleared.

    NEW CAR BROKERAGE SERVICE

  23. All new vehicle requirements will be fully defined and agreed between the client and MOTORMISSION Ltd. The client usually initiates this process by submitting a request, usually by email, to MOTORMISSION Ltd. This can also be achieved by phone.
  24. MOTORMISSION Ltd will send confirmation in the form of a New Vehicle Supply Agreement by email/post for the client's approval. The Agreement will contain the following information -
    1. Full details of the new car requirements as set out by the client, including any amendments that were subsequently agreed by email/telephone (e.g. any additional extras).
    2. Payment terms, including MOTORMISSION Ltd terms of business.
  25. When the client is completely satisfied with the Agreement, it should be signed and returned to MOTORMISSION Ltd together with the fee (see website for details).
  26. Upon receiving the Agreement and the payment, MOTORMISSION Ltd will issue an electronic receipt to the client's email address or by post to the customer's home address.
  27. MOTORMISSION Ltd will then proceed to locate the new vehicle direct from a main dealer at the most competitive price on behalf of the client. When the required vehicle has been located at the best price the client will be put in touch direct with the dealer to complete the deal. This usually takes the form of a deposit direct to the dealer to secure the order. From this point the client deals direct with the selected dealer although MOTORMISSION Ltd are happy to help should the client request assistance during the process.
  28. In the unlikely event that after 21 days MOTORMISSION Ltd are unable to locate a vehicle to comply with the New Vehicle Supply Agreement, MOTORMISSION Ltd guarantee (at the client's request) to return their fee by cheque. Also if MOTORMISSION Ltd are unable to save at least their fee compared against the On The Road Listed Price (as specified by the main dealer) of the car they will refund the fee. If MOTORMISSION locate a vehicle which complies with the New Vehicle Supply Agreement and the client decides not to proceed the fee is non-refundable.
  29. If MOTORMISSION Ltd locates a vehicle which complies with the New Vehicle Supply Agreement and the client decides thereafter not to proceed the fee is non-refundable.
  30. Subject to paragraph 29 above, should the client decide not to proceed within the first 5 days of MOTORMISSION Ltd receiving the signed Supply Agreement, MOTORMISSION Ltd would return the original fee, less an administration fee of £50 (plus VAT). This covers the cost of work that will have been undertaken on the clients behalf. Should the client decide not to proceed after the 5 day point and before the 21 day point, and with a vehicle which complies with the Supply Agreement not having been identified to the client, a refund of the deposit less £100 (plus VAT) would be paid.
  31. MOTORMISSION Ltd will not collect or deliver new vehicles to clients as part of this service.

    NEW CAR BROKERAGE – PART EXCHANGE

  32. Clients wishing to part exchange against their new car should provide as much detail on their car as possible to MOTORMISSION Ltd, ideally on the on-line proposal form used for used car finding. MOTORMISSION Ltd may subsequently contact the client to clarify their vehicle details after which, we would provide an indicative 'trade-in' value.
  33. All estimates quoted by MOTORMISSION Ltd are conditional and may be changed if the vehicle does not prove to be as the customer described on physical examination by the main dealer supplying their new car. Where possible a physical examination is always preferred.
  34. All estimates quoted by MOTORMISSION Ltd are conditional and may be changed if the vehicle does not prove to be as the customer described on physical examination. In the event that a vehicle for part exchange is found to have been subsequently damaged or is not in the condition described by the customer, then MOTORMISSION Ltd reserves the right to amend the estimate and/or terminate the Part Exchange. In this situation the client would have to provide the balance to the dealer before the new car is released.
  35. Subject to paragraph 34 above, all values quoted by MOTORMISSION Ltd are valid for a period of 21 days.

    NEW CAR BROKERAGE – PAYMENT TERMS

  36. The new car broker fee can be paid by cheque made out to ‘MOTORMISSION Ltd’. We also accept bank transfers. No work will be undertaken until receipt of cleared funds.
  37. All other payments will be made direct to the providing dealership. Their own payment terms and conditions will apply.
